OPINION

Floyd Grover Johnson appeals from the denial of his motion to dismiss the indictments for three counts of first-degree trafficking in a controlled substance, second or subsequent offense, and one count of delivery of drug paraphernalia, due to a lack of jurisdiction and the correspondingly entered conditional guilty plea. Johnson was sentenced to ten years of imprisonment. After a thorough review of the parties' arguments, the record, and the applicable law, we reverse and remand.

The facts of this appeal are not in dispute. On September 29, 2009, a multi-count indictment was returned by the Powell County Grand Jury charging Johnson with two counts of first-degree trafficking in a controlled substance (morphine and oxycodone), second offense. A second indictment charged Johnson with trafficking in morphine and delivery of drug paraphernalia. Johnson moved to suppress all evidence collected against him in the two cases and to dismiss the indictment because he argued that neither the Attorney General's Office nor the Operation UNITE1 detectives had jurisdiction to conduct the investigation in Powell County that led to Johnson's indictment. No local law enforcement officer from Powell County was involved in building the case against Johnson. Johnson asserted that the Attorney General's Office was not invited to participate in this investigation pursuant to Kentucky Revised Statutes (KRS) 15.200, and that the UNITE officers could not lawfully engage in the arrest because Powell County is outside the congressional district of Hal Rogers.

The Attorney General's Office of Special Prosecutions made an entry of appearance for the sole purpose of responding to Johnson's motion. The trial court held a hearing and heard the legal arguments of the parties. Thereafter, the trial court denied Johnson's motion, which the court styled as a motion to dismiss.

In denying the motion, the trial court relied on KRS 218A.240(1), which it found gave clear authority to the Attorney General to make arrests regarding controlled substances, both of which were authorized in the two indictments sub judice. Because of the court's finding that KRS 218A.240(1) was controlling, the court declined to address the authority or lack thereof of the UNITE officers outside of Hal Rogers's congressional district. The court then reasoned that it would seem that federal monies secured for the arrest of controlled substance dealers would not be limited to a congressional district. Johnson then entered a conditional guilty plea. It is from this that Johnson now appeals.

On appeal, Johnson presents one argument: namely, that the trial court erred to Johnson's substantial prejudice and denied him due process of law when it denied his motion to dismiss the indictments where neither the Attorney General's Office nor Operation UNITE had jurisdiction to investigate drug cases in Powell County. In support thereof, he argues: (1) the authority of the Kentucky Attorney General's Office to conduct investigation is limited by statute; (2) Operation UNITE is not authorized to act in Powell County and, since no local law enforcement officers were involved in these cases, the cases must be dismissed; and (3) it is simply inaccurate that an ordinary citizen could have instituted this case through independent investigation.

In response, the Attorney General's Office argues that the investigators of the Attorney General's Office acted within their common law and statutory jurisdiction and no officers exercised police powers during the investigation. In support thereof they argue: (1) the Attorney General had common law authority to investigate drug trafficking; (2) peace officers employed by the Attorney General are statutorily mandated to investigate and enforce KRS Chapter 218A; (3) private citizens could have collected the evidence; and (4) suppression and dismissal are not proper remedies.

From 24-27 January 2012 Patek Philippe brought the inaugural Watch Art Grand Exhibition to Dubai at the Madinat Jumeirah. The exhibition offered a rare insider's perspective into the art of watchmaking.

Patek Philippe designed the area to recreate its headquarters in Geneva, including workshops and its own museum. It showcased about 400 timepieces dating back to its origin in 1839, including 350 watches and 50 movements.

In his blog, atheist philosopher Stephen Law, poses a formal argument to be skeptical of Jesus's existence (this argument is a fine example of how the "extraordinary claims require extraordinary evidence" skeptical principle can be used to doubt whatever claim you don't want to believe. In the case of Jesus' existence, virtually no professional historian or scholar doubts of his existence on the grounds of an argument like Law's... I'll give as an example the best-selling author and influential critic of Christianity, the agnostic historian and New Testament scholar Bart Ehrman's reply to the denialism of Jesus' existence).

You have to keep in mind that Law is a philosopher, not a professional historian. So, in order to evaluate some of Law's premises in his argument, you will have to compare Law's knowledge of ancient history with the knowledge of history of contemporary professional historians.

Law's argument is this:

1. Extraordinary claims require extraordinary evidence. In the absence of extraordinary evidence there's excellent reason to be skeptical about the claims.

2. There is not extraordinary evidence for any of the divine/miraculous stuff in the NT documents.

3. Therefore (from 1 and 2), there's excellent reason to be skeptical about those extraordinary claims.

4. Where testimony/documents combine both mundane and extraordinary claims, and there's excellent reason to be skeptical about the extraordinary claims, then there's pretty good reason to be skeptical even about the mundane claims, at least until we possess some pretty good independent evidence of their truth.

5. The NT docs combine extraordinary and mundane claims about Jesus.

Just earning a degree does not mean she is superior to my mom who does not have a degree and does not work in some software company serving yankee clients.

The purpose of the engineering degree is to give the students (men or women) an opportunity to be self reliant, it does not (not directly) teach them about relationships and parenting.

Not having a degree does not make your mother any less but it does not mean your sister in law should have to prove her worth as a mother or daughter in law because she has the degree.

1. My mom did not leave us children rotting with stools still on our bums and asked our dad to clean us all the time, because her laptop kept her busy;

It's not right to expect your brother's life partner to be like your mother. She comes from a different generation – probably your generation. Would you like to be pitted against and asked to dress, read, work, travel, eat, sleep, sit, stand up etc as dictated by your sister in law's father? Women have feelings just like men do.

This kind of interference can create a lot of resentment. She is an equal family member and the mother of the child, and you need to respect that fact. Yes times are changing, and it's possible that she would like to ask you to mind your own business, and if she doesn't do that to avoid a scene ?

2. My mom did not avoid feeding us with her own milk because she was supposedly too busy and concerned about her beauty;

This is not your business. It is such comparisons and interference that puts women off traditional and conservative Joint Families. Respect her personal space and know when you are crossing personal boundaries. Did she say she didn't want to feed the baby and did she give the reasons you have given? Does that mean she was actually questioned? Why do you think it was okay for anybody except the parents to have a say in this?

3. My mom never treated her in-laws with disrespect – by sitting on the couch leg on leg and shaking her legs when her father in law came back from office;

A friend draws my attention to this:

When I send my children off to school in the morning I expect a few things to happen:

1) They should have fun at school

2) They should feel inspired and challenged

3) They should be allowed to explore their passions

Is that too much to ask! I don't want to hear why my second grader needs to take benchmark exams (which are more like midterm exams you take in college), simply because you want your school scores to test high so that you can receive more state funding. This is not why I send them to school and this is not the definition of teaching. If you have teachers who love to teach and do their job well… then get the hell out of their way and let them teach. If you have lousy teachers who do the bare minimum then fire them before they taint the minds of our children. An education is the right of every child, but teaching those children is a privilege.

[This is a post from my series on starting a new job for technical leaders like CTOs, VP Engineering, and Software Development Managers]

The crazy thing about managers is that the majority of your job is working with people – and unlike software, which is normally pretty deterministic, people can be unpredictable and difficult to understand.

Whenever you first join a new team the most important thing you can do is listen and observe.  Get to know the players and the company culture.  Here are some things to get a handle on in your first month:

  • How are new ideas presented?  Do people build consensus or just go forward?
  • Are meetings efficient?  Could they be improved?
  • What happens when things go wrong?  How are issues handled?
  • How are new employees on-boarded?  Is there any documentation?

In general I like to get on every email list, and attend every meeting that I can during my first few weeks.  It is a great way to immerse yourself in the way things are currently operating, which gives you the chance to make mental notes of inefficiencies or potential areas for improvement. Plus taking a few weeks to a month of just getting your feet is a great way to make sure that when you do have a change or suggestion, you are able to execute it within the norm of the company.

Meeting with your Team

During your first week or so, make sure you take the time to meet with each of your direct reports, and the other members of your team.  Getting face time with everyone in your organization shows that you care and can help you integrate faster – plus it gives you a great chance to get a full view of the organization and personalities in each pocket (and if you are in startup, then it is likely your team is relatively small so this should definitely be doable in the first few weeks on the job).

Your goal in these initial meetings should be to just listen and get to know each person.  This means actively listening and preparing a good list of questions ahead of time.  Here are a few to get you started:

When we are dissatisfied with things as they are, the status quo, the injustice, the oppression we see in the world, we begin to imagine what the world would be like if things were different--if there were no hunger or thirst and all tears were wiped away (Rev. 7:14). Creative redemptive imagination reaches toward God, and glimpses a new heaven and new earth are realized as potentially real...the kingdom. The new reality has nothing to do with the present order. In fact, the one who responds to this new imagination seeks to put something more beautiful in the place of what she sees. This is where the friction and fight begin.

Martin Luther King was not killed because he had a dream. Dreamers are easily dismissed. He was killed because he sought to introduce into the political arena what he saw with his heart and mind...I have a dream. The same was true of Gandhi. The same was true for Jesus, who dreamed what the prophets dreamed, he reimagined the world a new...and lived in the reality now. On earth, as in heaven...a cosmic collision of redemption in which the kingdom comes.
